§ 18
Information obligations and rights to information
(1) Providers of telemedia services which do not serve exclusively personal or family purposes must keep the following information easily recognizable, immediately accessible and permanently available:
1. Name and address and
2. in the case of legal entities, also the name and address of the authorized representative.
(2) Providers of telemedia with journalistic and editorially designed offers in which, in particular, the contents of periodical print products are reproduced in full or in part in text or images, must, in addition to the information pursuant to Sections 5 and 6 of the Telemedia Act, appoint a responsible person, stating their name and address. If several responsible persons are appointed, it must be indicated for which part of the service each person appointed is responsible. Only those who
1. has his permanent residence in the country,
2. has not lost the ability to hold public office by a court ruling,
3. has full legal capacity and
4. can be prosecuted without restriction.
Sentence 3 numbers 3 and 4 do not apply to young people who are responsible for telemedia intended for young people.
(3) Providers of telemedia in social networks are obliged to indicate the fact that content or messages are automatically created using a computer program, provided that the user account used for this purpose was made available for use by natural persons in terms of its external appearance. The content or message must be accompanied or preceded by a clearly legible note stating that it was automatically created and sent using a computer program that controls the user account. Creation within the meaning of this provision occurs not only when content and messages are automatically generated immediately before being sent, but also when prefabricated content or a pre-programmed message is automatically used for sending.
(4) Section 5 shall apply accordingly to providers of telemedia pursuant to paragraph 2 sentence 1.
Violations may be punished with fines pursuant to Section 115 MStV.
